Terms and Conditions of Sale
The terms and conditions of sale set out here apply to goods supplied to you (“the Buyer”) by Tracmaster Ltd (“the Company”), ordered from www.tracmaster.co.uk (“the Website”).
By continuing with your purchase it is deemed that you have read, understood and agreed to these terms and conditions.
Orders and Pricing
Tracmaster Ltd uses the Shopify platform as their online purchasing system and accepts payment by any of the credit cards shown on the Website at time of purchase. See Payment Security for more information.
All prices are shown in UK GBP sterling and are subject to carriage charges and VAT unless otherwise stated. Where applicable these charges will be added to the Buyer’s invoice upon confirmation of the Buyer’s billing and shipping addresses and payment details, and prior to completing the payment process.
The description and price of goods will be as shown on the Website at the time you place your order. Every effort will be made to ensure that prices shown on the Website are accurate at the time of purchase however all prices and descriptions on the Website are subject to change without prior notice.
If an error or discrepancy is discovered prior to despatch of the goods, Tracmaster Ltd will inform the Buyer as soon as possible to offer the option of either reconfirming the order at the correct price or cancelling the order.
When a Buyer orders online, confirmation will be sent to Tracmaster Ltd by email. If the Buyer has provided an email address then the Buyer will also receive an email receipt to confirm that Tracmaster Ltd has received the order. If the Buyer did not provide an email address, or if the confirmation email was not received by the Buyer, confirmation can be provided by Tracmaster Ltd by contacting the Company on 01444 247689.
Currently Tracmaster Ltd does not accept online orders from outside the UK. For orders outside the UK, please contact Tracmaster Ltd directly as terms and conditions, shipping prices and delivery times will differ to those stated on the Website. All goods are subject to availability. If on receipt of an order the goods are out of stock, Tracmaster Ltd will contact the Buyer as soon as possible. The Buyer will be entitled to cancel the order and obtain a full refund to the credit or debit card with which payment was originally made. Alternatively, Tracmaster Ltd may be able to offer the Buyer a suitable alternative, or advise of the estimated date that the goods will be available.
Tracmaster Ltd is under no obligation to accept any order and reserves the right to cancel orders placed on the Website at any time and without prior notice.
Delivery
All delivery times quoted on the Website are estimates based on stock availability, normal processing and delivery times. Where a single order comprises multiple items, Tracmaster Ltd will endeavour to deliver all the items together, however where it may be necessary to deliver items from the same order separately the original single carriage charge will still apply.
Goods ordered will be delivered to the address provided by the Buyer when the order was placed, unless arranged otherwise with Tracmaster Ltd in writing prior to the goods being despatched.
Goods are usually delivered via an courier delivery service and require a signature to be provided upon delivery. If there is no one available at the delivery address to accept delivery of couriered goods, the Buyer will be notified of an alternative delivery date or location from where to collect the goods. Tracmaster Ltd cannot accept responsibility for goods that are returned to the courier’s depot and remain uncollected.
Receipt of a signature for goods delivered to the address provided by the Buyer will constitute proof that the order has been delivered to, and received in satisfactory condition, by the Buyer.
Once an item is considered delivered as outlined above, responsibility for the item, risk of damage or loss will pass to the Buyer.
Tracmaster Ltd is not liable for any loss or damage suffered by the Buyer through any unavoidable delay in delivery of goods. Tracmaster Ltd is not liable for any damage which occurs to goods after a delivery has been made.
Returns and Refunds
Under the Sale of Goods Act 1979, if the goods are deemed to be faulty or not as described then the Buyer will be entitled to a full refund, a replacement, a repair and/or compensation from Tracmaster Ltd.

Faulty goods must be reported to Tracmaster Ltd as soon as reasonably possible.
Tracmaster Ltd accepts no responsibility for goods damaged or lost in transit.
In the event of goods having to be returned due to being faulty or not as described then return shipping costs will be paid by Tracmaster Ltd. If the Buyer pays for the return shipping then Tracmaster Ltd will reimburse this cost upon the Buyer providing an invoice or receipt from the shipping company.
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply to transactions via this Website.
The Buyer has the right to cancel the transaction provided the goods are returned to Tracmaster Ltd within 14 days. For goods returned within this time Tracmaster Ltd will provide a full refund within 14 days of receiving the returned goods.
Warranty
Our warranty policy is for the length of time specified on the Website at the time of purchase and guarantees against defects in materials or workmanship. If the goods are not satisfactory, in accordance with the terms of the warranty, please contact Tracmaster Ltd on 01444 247689 or email technical@tracmaster.co.uk.
Title and Risk
Risk shall pass to the Buyer upon delivery of the goods to the Buyer’s address. Notwithstanding this passing of risk, title in the goods shall remain with Tracmaster Ltd and shall not pass to the Buyer until the amount due under the invoice for the goods (including interest and costs where applicable) has been paid in full.
Until title passes to the Buyer goods must be stored or marked so that they can at all times be identified as the property of Tracmaster Ltd.
Payment Security
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
